By making a booking, the customer confirms that they have read, understood and accepted these Terms and Conditions.<\/p>\n\n<h2>1. Services<\/h2>\n<p>Lost In Madeira organises guided hikes in Madeira, for small private groups, on the routes listed on the website and in the booking confirmation.<\/p>\n<p>Each hike includes the services stated on the relevant activity page and in the confirmation email. The description, distance, duration, elevation gain, difficulty, transport and price are provided as a guide and may be reasonably adjusted due to weather conditions, safety, trail conditions or the needs of the group.<\/p>\n<p>The hikes take place in a natural environment, with uneven terrain, wet areas, steps, ascents and descents, narrow paths, tunnels and exposure to the weather. Taking part implies that the customer understands the nature of these activities.<\/p>\n\n<h2>3. Bookings and confirmation<\/h2>\n<p>Bookings can be made directly on the website, by WhatsApp, by email or through the contact form.<\/p>\n<p>A booking is only confirmed after:<\/p>\n<ol>\n  <li>Receipt of the requested details for all participants;<\/li>\n  <li>Payment of a deposit equal to 30% of the total booking value;<\/li>\n  <li>A confirmation email sent by Lost In Madeira.<\/li>\n<\/ol>\n<p>After confirmation, the customer will receive information about the hike, the meeting or pick-up point and time, the recommended equipment and any other necessary instructions.<\/p>\n<p>Hikes are organised for private groups and require a minimum of 2 participants. We do not combine participants from different bookings, unless expressly agreed in advance.<\/p>\n\n<h2>4. Prices and payment<\/h2>\n<p>The prices shown on the website are per person, unless stated otherwise.<\/p>\n<p>The 30% deposit is paid at the time of booking. The remaining 70% must be paid up to 72 hours before the hike.<\/p>\n<p>For bookings made less than 72 hours in advance, full payment may be required at the time of booking.<\/p>\n<p>A booking may be considered cancelled if payment is not made within the stated deadline. Any processing fees charged by payment platforms may be non-refundable, where applicable.<\/p>\n\n<h2>5. Transport and pick-up<\/h2>\n<p>Transport is included for groups of up to 4 people, with pick-up in central Funchal, unless otherwise stated on the hike page or in the confirmation email.<\/p>\n<p>For pick-ups at hotels or accommodation outside central Funchal, an additional charge may apply. For larger groups, if a van or other additional transport must be hired, extra costs may apply.<\/p>\n<p>Any additional transport cost will be communicated and confirmed by the customer before booking or before being charged.<\/p>\n<p>The customer must be ready at the confirmed pick-up point and time. Delays that prevent the hike from taking place may be treated as a no-show, with no right to a refund.<\/p>\n\n<h2>6. Cancellation by the customer<\/h2>\n<p>Cancellation or change requests must be made in writing, by email or WhatsApp, using the official Lost In Madeira contact details.<\/p>\n<ul>\n  <li><strong>More than 7 days before the hike:<\/strong> free cancellation or change; amounts paid will be refunded in full.<\/li>\n  <li><strong>Between 3 and 7 days before the hike:<\/strong> the 30% deposit is non-refundable. Where possible, it may be transferred to a new date, subject to availability.<\/li>\n  <li><strong>Less than 72 hours before the hike:<\/strong> no refund.<\/li>\n  <li><strong>No-show, late arrival or withdrawal after the activity has started:<\/strong> no refund.<\/li>\n<\/ul>\n<p>For leisure activities held on a specific date or during a specific period, the statutory 14-day right of withdrawal, which applies to many distance contracts, may not apply. The cancellation policy communicated at the time of booking will apply, without prejudice to statutory rights.<\/p>\n\n<h2>7. Changes or cancellation by the organiser<\/h2>\n<p>Safety comes first. Lost In Madeira may change, shorten, postpone or cancel a hike in the event of adverse weather, official trail closures, rockfall risk, fire, strong wind, poor visibility, landslides, unsafe terrain conditions, access problems, force majeure or other circumstances that may compromise the safety or quality of the activity.<\/p>\n<p>Wherever possible, an alternative hike or a new date will be offered.<\/p>\n<p>If no suitable alternative can be found, amounts paid for services that were not provided will be refunded in full. Lost In Madeira will not be liable for the customer&#8217;s indirect costs, including flights, accommodation, meals, external transport, lost holiday time or other personal expenses, without prejudice to rights arising under applicable law.<\/p>\n<p>If a hike has already started and needs to be changed or interrupted for safety reasons, no partial or full refund will be given, unless Lost In Madeira decides otherwise or the law provides differently.<\/p>\n\n<h2>8. Participation requirements<\/h2>\n<p>The customer is responsible for assessing whether the hike is suitable for their physical fitness, experience and health.<\/p>\n<p>Before booking, the customer should read the hike description, including the duration, distance, elevation gain and difficulty level. For long or demanding trails, good physical fitness and previous experience hiking on mountain or uneven terrain are required.<\/p>\n<p>The customer must inform Lost In Madeira, before the booking is confirmed, of any medical condition, allergy, recent injury, medication, pregnancy, mobility limitation or other factor that may affect safe participation in the activity.<\/p>\n<p>Lost In Madeira may refuse or interrupt the participation of any person if it considers that their physical condition, equipment, behaviour or health poses a risk to themselves, the group or third parties. In such cases, there may be no right to a refund, without prejudice to statutory rights.<\/p>\n\n<h2>9. Equipment and conduct<\/h2>\n<p>The customer must use the equipment indicated in the confirmation email, including, where applicable, hiking footwear with good grip, clothing suited to the conditions, water, a snack, sun protection, a waterproof or windproof jacket, and a torch or headlamp on routes with tunnels.<\/p>\n<p>The customer must always follow the guide&#8217;s instructions, respect the limits of the group, not leave the route without notice, and act responsibly towards the environment, other trail users and local property.<\/p>\n<p>It is not permitted to leave litter, damage vegetation, enter restricted areas, consume alcohol or substances that compromise safety, or behave in ways that put people or the environment at risk.<\/p>\n\n<h2>10. Insurance<\/h2>\n<p>The hikes include public liability insurance and personal accident insurance, applicable during the activity and subject to the terms, limits, exclusions and conditions of the respective policies.<\/p>\n<p>The inclusion of this insurance does not replace the recommendation that each participant hold personal travel insurance, including medical, cancellation, repatriation and outdoor activity cover, according to their needs.<\/p>\n<p>Coverage details and any procedures to follow in the event of an accident will be provided on request or at the time the booking is confirmed.<\/p>\n\n<h2>11. Liability<\/h2>\n<p>Lost In Madeira undertakes to organise the hikes with due care, in line with the safety conditions assessed on the day.<\/p>\n<p>However, hiking in a natural environment involves inherent risks, including falls, slips, injuries, sudden weather changes, unstable terrain, obstacles, sun exposure, cold, rain, wind, tunnels, loss of communication signal and delays.<\/p>\n<p>Within the limits permitted by law, Lost In Madeira will not be liable for losses, damage, accidents or expenses resulting from:<\/p>\n<ul>\n  <li>Incomplete or incorrect information provided by the customer;<\/li>\n  <li>Lack of adequate physical fitness or failure to follow the guide&#8217;s instructions;<\/li>\n  <li>Use of inadequate equipment;<\/li>\n  <li>Actions of third parties, natural phenomena, force majeure or circumstances beyond the organiser&#8217;s reasonable control;<\/li>\n  <li>Loss, damage or theft of personal belongings.<\/li>\n<\/ul>\n<p>Nothing in these Terms and Conditions excludes or limits consumer rights or liabilities that cannot be excluded or limited by law.<\/p>\n\n<h2>12. Photographs and videos<\/h2>\n<p>During the hikes, photographs or videos may be taken for the purposes of communicating and promoting Lost In Madeira, including on the website and social media.<\/p>\n<p>If you do not authorise the use of your image, you must inform us in writing before the hike begins. Your participation will not be affected by this decision.<\/p>\n\n<h2>13. Personal data<\/h2>\n<p>Personal data collected during booking is used to manage the booking, communicate with the customer, organise the activity, comply with legal and insurance-related obligations, and ensure participants&#8217; safety.<\/p>\n<p>For more information on how personal data is processed, please see the Lost In Madeira <a href=\"\/politica-de-privacidade\">Privacy Policy<\/a>.<\/p>\n\n<h2>14. Complaints and governing law<\/h2>\n<p>Any question or complaint should be raised as soon as possible through [email] or [WhatsApp], so that we can seek an appropriate solution.<\/p>\n<p>These Terms and Conditions are governed by Portuguese law. In the event of a consumer dispute, the customer may have recourse to the legally competent alternative consumer dispute resolution bodies.<\/p>\n\n<h2>15. Changes to the Terms and Conditions<\/h2>\n<p>Lost In Madeira may update these Terms and Conditions at any time.
